1. Information Collection
Xego is the sole owner of the information collected on this site. Xego will not sell, share, or rent this information to others in ways different from what is disclosed in this statement.

Anonymous Information
You can visit the Site to read information about our company, products, and services without telling us who you are and without revealing any personal information. To improve the usefulness of our site, Xego measures and analyzes non-identifying, aggregate usage, and volume statistical information from Users in order to administer our Site, and to constantly improve the quality of our service and site performance.

Registration
To use most areas of this web site, a User must first complete the registration form. During registration within our Shipping, Affiliate, and Online User Account Registries a User is required to provide contact information (including name,email address, company, address, phone number, and in some instances Tax ID number or Social Security number) in order to create an account. This information is used to contact the User about the services on our site for which they have expressed interest.

Order
Xego requests information from the User on an order form. The information that is collected to process the order may include contact information (name, shipping address, telephone number, fax number and/or email address) and financial information (credit card number, name on account, expiration date). This information is used for billing purposes and to fill customers orders. This contact information is used to contact the User. See Service Providers to learn about how we share this information with trusted third parties.

Newsletter
A User may subscribe to our newsletter at this page, or while creating an account for our online store. If a User wishes to subscribe to our newsletter, we ask for contact information such as name and email address. .If you elected to be added to the newsletter, you will be sent a confirmation signup email that will require you to reply to the message in order to be added to the newsletter. If you wish to be removed from the newsletter at any time, please go to this page.

Tell-a-friend
If a User elects to use the Xego referral service for informing a friend about our site, Xego asks for the friends name and email address. Xego will automatically send the friend a one-time email inviting them to visit the site. Xego stores this information for the sole purpose of sending this one-time email.

Testimonials
Xego provides an audio testimonial service for Users wishing to inform Xego about their experiences and results while using our products. Xego reviews and transcribes the testimonials. At Xego's discretion testimonials may be chosen for inclusion on Our Site. Xego requires Users of the Testimonial service to provide contact and demographic information. Participation in this service is completely voluntary and the User therefore has a choice whether or not to disclose this information. Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code, age level).

Cookies
A cookie is a piece of data stored on the users hard drive containing information about the User. Usage of a cookie is in no way linked to any personally identifiable information while on our site. Once the User closes their browser, the cookie simply terminates. For instance, by setting a cookie on our site, the User would not have to log in a password more than once, thereby saving time while on our site. If a user rejects the cookie, they may still use our site. The only drawback to this is that the User will be limited in some areas of the Xego site.

Log Files
Xego uses IP addresses to analyze trends, administer the site, track users movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

2. Sharing
We do not share your personally identifiable information with any third parties who are not agents or service providers for any purpose including their own marketing purpose except as described in this privacy policy. Xego shares aggregated demographic information with Xego partners and advertisers. This is not linked to any personal information that can identify any individual person.
Xego uses several credit card processing companies and banks to bill users for goods and services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes Incuding their own marketing purposes.

Xego may partner with another party to provide specific services including but not limited to product delivery , email marketing, and audio testimonial recording . When the user signs up for these services, Xego may share names, or other contact information that is necessary for the third party to provide these services. These parties are not allowed to use personally identifiable information except for the purpose of providing these services. Users wishing to opt-out of this sharing may go to this page.

Xego may release personally identifiable information when Xego believes, in good faith, that such release is reasonably necessary to comply with law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our website. In addition, we may release personally identifiable information to prevent fraud, enforce or apply the terms of any of our user agreements or to otherwise protect the rights, property and safety of Xego, and our customers or other third parties.

3. Service Providers
Billing
Xego uses third parties to provide credit card processing on our site. When you order products on our site , we will share your credit card information and personally identifiable information as necessary for the third party to provide that service.

Delivery Service Providers
Xego uses third parties to provide product delivery services for our site. When you order products on our site , we will share your personally identifiable information as necessary for the third party to provide that service.

Email Marketing
Xego uses third parties to provide newsletter list management and newsletter delivery services on our site. When you subscribe to our newsletter, we will share your contact information as necessary for the third party to provide that service.

4. Communications From The Site
Xego will send Users only service-related announcements from time to time through the general operation of the Site. For instance, if you register for an account or place an order, you may receive an email alerting you to that fact or an email requiring you to verify the account registration. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account or not place an order.

Security
This web site takes every precaution to protect Users information. When users submit sensitive information via the website, the information is protected both online and off-Line. When the Xego registration/order form asks users to enter sensitive information (such as credit card number,Tax ID and/or social security number), that information is encrypted and is protected with encryption software.

While on a secure page, the lock icon on the bottom of Web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked, as opposed to un-locked, or open, when a User is surfing. While Xego uses encryption to protect sensitive information online, Xego also uses its best efforts to protect user-information off-line. User information, not just the sensitive information mentioned above, is restricted in Xego offices. Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) are granted access to personally identifiable information.
We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.

5. Correcting/Updating Personal Information:
If a users personally identifiable information changes (such as your zip code), or if a user no longer desires our service, we will endeavor to provide a way to correct, update or remove that user's personal data provided to us. This can usually be done at the member information page or by emailing Customer Support.

Xegolife.com Affiliate Program Agreement

This Agreement contains the complete terms and conditions that apply to your participation as a member of the Xego Program (the program) operated by The Xego Company (hereinafter, company, we or us). As used in this Agreement, you or your means the applicant/participating member.

THIS IS A LEGAL AGREEMENT BETWEEN YOU AND COMPANY. BY CHECING THE AGREE BOX AT THE END OF THIS DOCUMENT YOU ARE STATING THAT YOU HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS SET FORTH HEREIN AND ARE INDICATING YOUR ACCEPTANCE OF THIS PARTNER PROGRAM AGREEMENT AND YOU AGREE TO BE BOUND BY THE TERMS HEREOF. YOU CANNOT BECOME A MEMBER OF THE PARTNER PROGRAM UNLESS YOU HAVE ACCEPTED EACH AND EVERY TERM HEREOF.

1. Enrollment in this Program
To begin the enrollment process, you will submit a completed application through our website www.xegolife.com. We will evaluate your application in good faith and will notify you of your acceptance or rejection. We will reject your application if we determine that you have provided inaccurate or incomplete signup information, or determine that your site is unsuitable for the Program for any reason, such as sites that facilitate illegal activity or promote violence or promote or assist others in promoting copyright infringement (collectively, ontent Restrictions).

2. Utilizing Links on Your Site.
As an partner of COMPANY, you may use any form of promotion you choose, consistent with the terms of this Agreement. You may use banner advertisements, button links and/or text links to our site (the inks), however, you cannot employ deceptive language or misleading URL in the Links, and you CANNOT MARKET BY SENDING UNSOLICITED BULK E-MAILS!!! (As used herein, UBE, or spam refers to the transmission of unsolicited bulk e-mails, i.e., not derived from a verifiable opt-in program or sent absent a prior business relationship with the recipient). Any activity by you or on your behalf that we determine or reasonably suspect to be the result of an unsolicited bulk e-mail program will result in your immediate termination from the Program and your forfeiting of monies otherwise due you hereunder. (For further guidelines on this topic, please see Section 5, below.) Allowable promotional links may contain COMPANY trade names, service marks, and/or logos for display on your Partner Site.

3. Commissions
The Program comes in one form of commission payout - revenue sharing. We will pay you a percentage of all monies earned from product sales.
The Commission Rate is subject to change from time to time, upon e-mail notice to you. Note that a commission will only be paid if the visitor to our site can be tracked by the system from the time of the Link to the time of the sale. No commission will be paid if the visitor payment to our site cannot be tracked directly to your site by our system or if full payment for services is not made to us by the customer. No commission will be paid for sales by you or anyone within your organization.

4. Commission Payment
Commissions will be paid to you directly by our affiliate marketing partners on monthly or bi-weekly basis (depends by affiliate marketing partner).

5. Acceptable Use Policy Regarding Bulk E-mailings
We do allow Partners to market websites promoted through this Program through the transmission of bulk e-mails, however, it is extremely important that any such mass e-mailings by you conform to our policies. Moreover, you need to be aware of the fact that many service providers, such as America Online, Inc. (AOL), have their own standards and policies when it comes to mass mailings to their members.
The marketing of websites promoted by this Program is strictly prohibited if done through the transmission of unsolicited bulk email. In other words, you must have a prior business relationship with the e-mail recipient, including but not limited to having obtained their e-mail address through a verifiable opt-in procedure.

6. Non-Exclusive Limited License and Use of Partner Logos and Trademarks
You grant us a non-exclusive license to utilize your names, titles and logos, trademarks (collectively the Partner Trademarks), to advertise, market, promote and publicize in any manner our rights hereunder. Notwithstanding anything herein to the contrary, we shall not be required to so advertise, market, promote or publicize. You hereby represent and warrant that you are the sole and exclusive owner of the Partner Trademarks and have the right and power to grant to us the license to use same in the manner contemplated herein, and such grant does not or will not (i) breach, conflict with or constitute a default under any agreement or other instrument applicable to you or binding upon you, or (ii) infringe upon any trademark, trade name, service mark, copyright, or other proprietary right of any other person or entity. This license shall terminate upon the effective date of the expiration or termination of this Agreement.

7. Term of the Agreements
The term of this Agreement will begin upon our acceptance of your Partner Program Application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party notice of termination. Notice by e-mail, to your e-mail address on our records, is considered sufficient notice for us to terminate this Agreement. If this Agreement is terminated because you have violated the terms of this Agreement, you are not eligible to receive any commission payments, even for commissions earned prior to the date of termination. If this Agreement is terminated for any other reason, you are only eligible to earn a commission on sales occurring during the term of the Agreement, and commissions earned through the date of termination will remain payable only if the related orders are not canceled or returned. We reserve the right to withhold your final payment for a reasonable time to ensure that the correct amount is paid.

8. Modification
We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion. Notice of any change by e-mail, to your address on our records, or the posting on our site of a change notice of a new agreement, is considered sufficient notice for notifying you of a modification to the terms and conditions of this Agreement. Modifications may include, but are not limited to, changes in the scope of available commission fees, commission schedules, payment procedures, and Partner Program rules. All such modifications shall take effect 48 hours after we serve notice as provided above, unless we indicate otherwise. If any modification is unacceptable to you, your only recourse is to terminate this Agreement. Your continued participation in the Partner Program, following our posting of a change notice or new agreement on our site, will constitute binding acceptance of the change.

9. Relationship of Parties
You and COMPANY are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict anything in this Section. You are not an agent of the COMPANY and COMPANY expressly disclaims responsibility for any conduct by you in violation of our terms of agreement.

10. Limitation of Liability
We will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data, arising in connection with this Agreement or the Partner Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Partner Program will not exceed the total commissions paid or payable to you under this Agreement.

11. Disclaimers
We make no express or implied warranties or representations with respect to the Partner Program or any COMPANY services or other items sold through the Program (including, without limitation, warranties, merchantability, non-infringement, or any implied warranties arising out of a course of performance, dealing, or trade usage). In addition, we make no representation that the operation of our site will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.

12. Representations and Warranties
You hereby represent and warrant to us that this Agreement has been duly and validly executed and delivered by you and constitutes your legal, valid and binding obligation, enforceable against you in accordance with its terms; and that the execution, delivery and performance by you of this Agreement are within your legal capacity and power; have been duly authorized by all requisite action on your part; require the approval or consent of no other persons; and neither violate nor constitute a default under the (i) provision of any law, rule, regulation, order, judgment or decree to which you are subject or which is binding upon you, or (ii) the terms of any other agreement, document or instrument applicable to you or binding upon you.

13. Confidentiality
We may disclose to you certain information as a result of your participation as part of the Program, which information we consider to be confidential (herein referred to as Confidential Information). For purpose of this Agreement, the term Confidential Information shall include, but not be limited to, any modifications to the terms and provisions of this Partner Program Agreement made specifically for your site and not generally available to other members of the Partner Program, website, business and financial information relating to COMPANY, customer and vendor lists relating to COMPANY and any members of the Partner Program, other than you. Confidential Information shall also include any information that we designate as confidential during the term of this Agreement. You agree not to disclose any Confidential Information and that such Confidential Information shall also include any information that we designate as confidential during the term of this Agreement. You agree not to disclose any Confidential Information and that such Confidential Information shall remain strictly confidential and secret and shall not be utilized, directly or indirectly, by you for your own business purposes or for any other purpose except and solely to the extent that any such information is generally known or available to the public or if same is required by law or legal process. Should you received a court notice, complaint or subpoena requesting or seeking to compel disclosure of Confidential Information, you shall immediately inform COMPANY and COMPANY shall have the right, and be given the opportunity, to obtain a protective order to prevent disclosure of such Confidential Information. We make no warranty, expressed or implied, with respect to any information delivered hereunder, including implied warranties of merchantability, fitness for a particular purpose or freedom from patent, trademark or copyright infringements, whether arising by law, custom or conduct, or as to the accuracy or completeness of the information and we shall not have any liability to you or to any other person resulting from your or such third persons use of the information.

14. Indemnification
You hereby agree to indemnify, defend and hold harmless COMPANY, its shareholders, officers, directors, employees, agents, partners, successors and assigns, from and against any and all claims, losses, liabilities, damages or expense (including attorney fees and costs) of any nature whatsoever incurred or suffered by us (collectively the osses), in so far as such Losses (or actions in respect thereof) arise out of or are based on (i) any claim or threatened claim that our use of the Partner Trademarks infringes on the rights of any third party; (ii) the breach of any promise, covenant, representation or warranty made by you herein; or (iii) or any claim related to your site.
